Victim In Serious Condition After DUI Crash In Elwood.




Elwood- On 12/04/2021 at approximately 7:40PM police was dispatched to an accident at 1526 S. RT 37, car versus pedestrian. Dispatch then advised that the person is laying on the ground, unknown if they were breathing.


Upon arriving on scene police observed a gold Ford Windstar van, with Indiana plate stopped on RT 37 and a female laying on the ground in front of the vehicle. The female was slightly moving, screaming in pain. At this time the Elwood Fire Department was arriving on scene for medical treatment. police also observed what appeared to be heavy damage, for striking a pedestrian, to the front of the Ford, with fluid leaking from the engine onto the roadway. The driver of the Ford (Brenda Collier) stated she was just pulling in to get food and this girl landed on top of her car, on her windshield. The driver again stated that she was just going to get Mexican and she landed on her windshield. When police asked for her drivers license The driver searched the same areas in her vehicle repeatedly, having trouble locating her information. The driver did eventually locate her registration and insurance providing them to police. police identified the driver to be Brenda K. Collier, 05/17/1958.



Brenda stated that she was in the turn lane, to go pickup Mexican food, then the girl was on her windshield. Brenda could not tell police how fast she was going. Brenda continued making comments about her Mexican food, and was very concerned about picking it up. Brenda then stated that the girl had no shoes on. Upon walking behind the Ford police observed two sandals laying in the roadway approximately 60 feet South of where the girl was laying. Police then returned to Brenda, asking if she had consumed any alcohol to which she stated she had drank two beers.


Brenda was then given Field Sobriety:

Horizontal Gaze Nystagmus-Failed

Walk and Turn-Failed

One Leg Stand-Failed

Brenda submitted to a P.B.T. providing a breath sample reading of .099


Brenda was then transported to the Elwood Police Department to collect a blood draw kit. Brenda was then transported to St. Vincent Mercy Hospital where she submitted to a blood draw. RN performed the blood draw, obtaining then providing police with two viles of blood to be sent to the lab for testing. Officer Cody Antrim then transported Brenda to the Madison County Jail. The Ford was impounded at Elwood Tire by Elwood Tire. The victim was transported to St. Vincent Mercy Hospital where she was then transferred by Statflight in serious condition.



Brenda Collier was transported to the Madison County Jail where she was charged with,

-OWI Causing Serious Bodily Injury, a Level 5 felony under IC 9-30-5-4 for operating a gold 2003 Ford Windstar, while intoxicated striking a pedestrian causing serious bodily injury;

-OWI Endangering, a Class A misdemeanor under IC 9-30-5-2 for operating a gold 2003 Ford

Windstar, while intoxicated striking a pedestrian causing serious bodily injury;

-Reckelss Driving, a Class A misdemeanor under IC 9-21-8-52 for operating a gold 2003 Ford

Windstar, while intoxicated at an unreasonable speed, unable to observe a

pedestrian in the roadway and striking the pedestrian causing serious bodily injury;

-Criminal Recklessness, a Class B misdemeanor under IC 35-42-2-2 for knowingly operating a gold

2003 Ford Windstar, while intoxicated striking a pedestrian causing serious bodily injury;

-OWI > .08, a Class C misdemeanor under IC 9-30-5-1 for operating a gold 2003 Ford Windstar, while intoxicated submitting to a P.B.T. submitting a breath sample of .099
